Trademarks are the intangible property that play the pivotal role for boosting and accelerating the economic growth of a corporation or body or business enterprise. For making a well-known brand in domestic and global arena requires investment, hard-working, creation of unique brand (distinctiveness), protection and proper management. Becoming a well-known mark, it posits distinctiveness and different from the mark of other’s business rival and provides advantages to its owner. In that stage, the mark faces challenges and threat in everywhere. In essence, the protection of the mark is vehemently required. 

Trademark is to be protected in two ways in national and international level. Trademark can be, at first instance, protected by registration of the mark in the national Intellectual Property (IP) Office. In international level, trademark application is to be filed either in IP office of each country or WIPO’s Madrid system. Bangladesh is still not signatory state of the WIPO’s Madrid System. So, the Trademark application is to be filed directly in the national IP Office of Bangladesh. Trademark registration provides the exclusive rights to use the registered mark. Thus, the proprietor can use the mark exclusively for making, using, importing the goods and services or license to another party in return for payment. Trademark registration also provides and confers legal certainty and reinforces the rights of the proprietor in case of litigation. Trademark protection is perpetual in nature subject to renewal of the registration in time to time after expiration of the registration period.
