Patent

A patent either for a product or process is granted for an invention, which provides a new technical solution for problems or a way to do something conditioning to be disclosed the invention publicly. For inventing anything else, it requires enormous investment, amenities, utilities, manpower, hard-working etc. In the process of making invention, patent faces challenges and threat of infringement of patent rights in everywhere. Thus, the protection of the patent is to be availed for taking its advantages and benefits.

The patent protection is territorial in nature. A Patent can be, at first instance, granted by the national Intellectual Property (IP) Office of the originating country. In international level, the patent is to be granted either in IP office of each country or under the Patent Cooperation Treaty system. Bangladesh is not still the signatory state of the Patent Cooperation Treaty. So, the patent application is to be filed directly in the national IP Office of Bangladesh. The patent protection provides the exclusive rights to the owner to prevent other for commercially exploiting the invention. Thus, the proprietor can use the patent rights exclusively for making, using, importing the goods or license to another party in return for payment. None can make, use, distribute, import, and sell the patent rights without permission of the patent holder.
